Anti-terrorism & Martyn’s Law

There have been 14 domestic terror attacks since the start of 2017 in the UK. Martyn’s law is being introduced by the family of a victim of the Manchester Arena terror attack and has passed through into parliament.

“The proposed Bill would impose requirements in relation to certain premises and events to increase their preparedness for, and protection from, a terrorist attack by requiring them to take proportionate steps, depending on the size and nature of the activities that take place at their premises.” www.gov.uk

The proposed requirements would apply to those responsible for qualifying public premises and qualifying public events. They might be individuals but, in most cases, would likely be a business or other organisation. If premises or an event did not meet certain prescribed qualifying conditions, then the proposed requirements would not apply in relation to them. One of the conditions for premises would be that they be wholly or mainly used for a listed purpose, such as the provision of entertainment and leisure facilities to the public.

Standard Tier (Capacity: 100-799 Individuals)

Notify the Regulator that they are, or have become, responsible for premises within scope of the Bill (and so subject to the relevant requirements). This remains broadly in line with previous requirements.

Have in place procedural measures that could be expected to reduce, so far as reasonably practicable, the risk of physical harm to individuals at the premises in the event of an attack. These relate only to the procedures to be followed by people working at the premises in the event of an attack occurring or being suspected as about to occur. As the procedural measures are about procedures for responding to an attack or suspected attack, it is not expected or required that physical alterations be undertaken or additional equipment purchased for Standard Tier premises.

In contrast to the published draft Bill, there is no requirement to complete a specified form (the ‘Standard Terrorism Evaluation’) for Standard Tier premises or ensure that people working at the premises are given any specific training. However, as part of putting in place the procedural measures, workers will need to be sufficiently instructed or trained to carry them out effectively.

Enhanced Tier (Capacity: 800+ Individuals)

– notify the Regulator of their premise or event;

– take ‘reasonably practicable’ measures that will reduce the risk of a terrorist attack occurring or physical harm being caused. The reasonably practicable test is utilised in other regulatory regimes e.g. Health and Safety, and will enable organisations to tailor their approach to the nature of the premises, and their activities and resources;

– keep and maintain a security document, aided by an assessment of the terrorism risk, which must also be provided to the Regulator; and

– if the responsible person is a body corporate, they must appoint an individual as the designated senior individual for the premise or event

If Enhanced Tier premises and qualifying public events do not comply with these requirements, the Regulator can issue compliance notices, and should non-compliance continue will be able to issue a maximum fixed penalty of the higher of £18 million or 5 per cent of worldwide revenue.

Shallow Pedestrian Rail and Bridge Expansion Solutions

There are two pedestrian rail solutions depending on client requirements. The first solution has a shallow solution of 400mm impact tested at 90 Degrees. with a tool category for a more determined opportunist attack. Tested with tools with a higher mechanical advantage and requiring more physical force.

The latest innovation is designed to meet requirements of bridge expansion joints. Tested with a clearance of 4.1m between bollards and only 50mm of foundation producing only 0.5m of penetration. This product however has uses way beyond just bridging expansion joints.

Sliding Gates

Cantilever Sliding Gates – 40 & 50 mph

There are two cantilever sliding gate solutions depending on client requirements. The INTERROGATOR PAS68 cantilever sliding gate has been successfully tested at 40mph and 50mph with a 7.5T (N2 and N3) vehicle respectively. Eagle continue to lead the field with their innovative arrestor system. At 8m opening it is the widest cantilever gate tested with the N3 vehicle at 50mph whilst producing only 1.6m of dynamic penetration.

The gate is powered by an electric motor with a hydraulic locking pin. Typical operating times are 35 sec seconds for an 8m opening (250mm/sec).

The gate is supplied from the factory as a complete assembled tested unit. Both the 40mph and 50mph products have the same foundations with a depth of only 380mm. Drawings are available on request.

The gate is either electrically or hydraulically driven dependant on client specification. The gate has a locking pin ensuring that it is secure before impact. The gate is very smooth and quiet with exceptional control in both directions. It has a powerful PLC with built in diagnostics and programmable inputs and outputs that can provide numerous options depending on client requirements. In the event of a power failure the gate has a full manual override system. The option of a powerful hydraulic motor is also available.

Compliant with EN 12453:2001 that recommends a minimum level of safeguarding for automatic gates. The gate comes as standard with CAT3 safety edges and light curtain that protects the threshold. Additional options include laser safety devices to protect zones. The control panel also has a dual channel loop card compatible with safety induction loops if required.
